The webshop shop.pohjalabeer.com (hereinafter the Webshop) is owned by Põhjala retail OÜ (registry code 12717499), located at Peetri 5, Tallinn 10145.
Validity of the sales contract, product and price information
The terms of sale apply to purchases of goods from the Webshop. The prices of the products sold in the online store are indicated with the products and include VAT. For alcoholic products package deposit in sum of 0.1 € is added The delivery fee is added to the price. The delivery fee depends on the location of the buyer and the method of delivery. The delivery fee will be shown to the buyer when placing the order. Product information is available in the Webshop directly at the item.
Ordering
You have to add the desired products to the shopping cart. To place an order, fill in the required fields and choose the appropriate delivery method. The amount of the fee will then be displayed on the screen, which can be paid through a bank link or other payment solution. The Agreement shall enter into force upon receipt of the amount due into the bank account of the Webshop. If the ordered goods cannot be delivered due to the end of the goods or for any other reason, the buyer shall be informed as soon as possible and the money paid (including delivery costs) shall be refunded immediately, but not later than within 14 days of dispatch. Alcoholic products are sold only to people of ascertain age (i.e 18 years old). Buyers are obliged to certify that being of age with ID-card upon receiving the package. Fee for transportation will not be returned when goods has been returned to webshop on the reason that buyer has failed to prove being of age with ID-card.
Shipping
Alcoholic products are delivered only within Estonia in partnership with SmartPost. Smartpost parcel terminals are across Estonia in different shopping centers. Parcels can be picked up while the shopping centers are opened. Buyer will be notified if the package has been delivered to terminal via text message which includes a code for opening terminal’s door. Packages are held in terminal for 7 days.

The cost of shipping the goods is covered by the buyer and the corresponding price information is displayed next to the shipping method. Domestic shipments generally arrive at the destination specified by the buyer within 3-7 business days of the entry into force of the contract of sale. Delivery outside Estonia is within 30 calendar days. In exceptional cases, delivery may take place up to 45 calendar days.
Right of withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the Webshop within 14 days. The right of withdrawal does not apply if the buyer is a legal entity. In order to exercise the 14-day right of return, the ordered goods may not be used in any other way than is necessary to ascertain the nature, characteristics and functioning of the goods as permitted by the physical store test. According to Obligations act 14 day right of return shall not apply to such goods in sealed packaging which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
If the goods have been used for purposes other than those necessary to ascertain the nature, characteristics and functioning of the goods, or if they show signs of use or wear, the Web Store has the right to reduce the refundable amount in proportion to the value of the goods. To return the item, you must submit a withdrawal form and send it to the e-mail address pohjala@pohjalabeer.com no later than 14 days after receipt of the item. The cost of returning the goods shall be covered by the buyer, unless the reason for the return is the fact that the item to be returned does not correspond to the order (eg, a wrong or defective item). The buyer must return the goods within 14 days of submitting the application or provide proof that he has delivered the goods to the carrier within the said period. Upon receipt of the returned goods, the Webshop shall refund to the Purchaser any fees received from the Purchaser under the Agreement immediately, but not later than 14 days after receipt of the application for withdrawal. The Webshop may refuse to refund until the item that is the subject of the contract has been returned or the buyer has provided proof of return, whichever is earlier. If the buyer has explicitly opted for a method of delivery other than the cheapest standard delivery method offered by the Webshop, the Webshop does not have to reimburse the consumer for any cost exceeding the standard delivery method.
The Webshop has the right to withdraw from the sale and to reclaim the goods from the buyer if the price of the goods in the Webshop is mistakenly marked below the market price.
Right to file a claim
The Webshop shall be liable for any lack of conformity or defect in the goods sold to the Purchaser, which existed at the time of delivery of the item, and which occurs within two years of delivery of the goods to the Purchaser. Within the first six months of delivery of the item to the buyer, the defect is presumed to have existed at the time of delivery. It is the Webshop's responsibility to rebut this assumption. The purchaser is obliged to contact the Webshop within two months at the latest, by sending an e-mail to shop@pohjalabeer.com or by calling +372 5666 3858. The web shop is not responsible for any defects that have arisen after delivery of the goods to the buyer which are caused by inadequate storing conditions, unpurposeful use of the goods or action/inaction by the buyer. If any item purchased from the Webshop has defects for which the Webshop is responsible, the Webshop will repair or replace the defective item. If the goods cannot be repaired or replaced, the Webshop will refund to the Purchaser all the fees associated with the contract of sale. The Webshop responds to a consumer complaint in writing or in a format that can be reproduced in writing within 15 days.
Direct marketing and processing of personal data
The Webshop will only use the personal information (including name, phone number, address, email address, bank details) entered by the buyer to process the order and send the goods to the buyer. The Webshop transmits personal information to the transport companies in order to deliver the goods.
Solving arguments
If the Purchaser has any claims regarding the Webshop, they should be emailed to shop@pohjalabeer.com. If the Purchaser and the Webshop cannot resolve the dispute by agreement, the Purchaser may refer the matter to the Consumer Disputes Committee. The Consumer Disputes Committee is competent to resolve any disputes arising from the contract between the purchaser and the Webshop. The Committee review of the purhcaser's complaint is free of charge. The purchaser can turn to the European Union Consumer Dispute Resolution Platform.
